DESIGNED VACATIONS CUSTOMER AGREEMENT

Thank you for choosing to book your travel arrangements with Designed Vacations. In this customer agreement
(Agreement), you’ll find important information about your travel arrangements. All sales are subject to the terms
defined in this agreement. This contract is governed by and subject to Michigan State law. All transactions,
whether payments, penalties, or refunds, are transacted in US Dollars at the rate current at the time of the
transaction. We are not responsible and will make no adjustment for exchange rate differences due to currency
fluctuations.


Designed Vacations (hereinafter Travel Agency) is an agent for our suppliers as identified on all travel documents.
Travel Agency participates in selling travel-related services, booking appointments/reservations for guests such as:
air and ground transportation, hotel accommodations, meals, tours, cruises, etc.… Therefore, travel agency shall
not be responsible for any damages arising from the harm or conduct caused by our suppliers or our principles.
Travel Agency will not be responsible for our supplier's negligence, breach of contracts, or are suppliers' failure to comply with all local and federal laws. By booking with Travel Agency, you (hereinafter Customer) are agreeing to every provision of this Agreement whether or not you have read it.

 

Travel Agency does not guarantee supplier’s rates, bookings, reservations, connections, scheduling, or handling of baggage or other personal property. Customers are responsible for ensuring their travel plan meets their standards and assume all risks associated with their vacations booking and traveling. Travel Agency’s hotel and flight recommendations are strictly suited based on Customers preferences in association with amount willing to spend and geographic area where they would like to stay. Travel Agency is not responsible should any of the above-mentioned travel-related services chosen by the Customer not fulfill the customers standards or cause injury or harm to Customer. It is the Customers duty to ensure the geographic area, hotel, and flight meet their
requirements prior to booking through the Travel Agency. Customer is responsible for any price adjustment or
changes made after booking.

 

Risk:
Customer assumes any risk associated with traveling while on their trip. Travel Agency shall not be responsible for any injuries, lost items, or any damages caused by but not limited to terrorism, social or labor unrest. Additionally, Travel Agency is not responsible for harm caused by the negligence of any airline, taxi, hotel, or act of God. Customer assumes the risk of any changes or cancellations of travel due to weather conditions, hotel services, accidents, or health related problems before or while in transit. Customer has a duty to mitigate any risk or damages associated to their trip.

 

Cancellation and Insurance:
By signing this Agreement, Customer acknowledges they have been offered traveler insurance at the time of
booking. If traveler insurance is accepted, it must be paid in full at the time of booking. Travel Agency is not
responsible for any cancellations and the Customer agrees to bear the burden of unexpected cancellations.

 

Refunds:
If travel plans are delayed or cancelled for any reason, there will be no refunds issued by Travel Agency.
Additionally, no refunds will be issued if there is a cancellation due to terrorism, pandemics, fear of travel, act of
God, or any other unforeseen event.

 

Fees:
To begin work, an initial planning fee is required. Hours of research and planning go into every quote and our time is valuable. Fees vary depending on the type of trip and the number of travelers. Once the appropriate fee is paid in full, Designed Vacations will begin researching and designing your trip. This fee is non-refundable and is separate from the cost of your trip.

 

The planning fee includes a minimum of two (2) itinerary/trip options specifically designed to fit the client’s budget and preferences. Clients have 45 days to make a deposit on a booking from the date the first quote is delivered. Bookings made after the 45-day mark will require the payment of another planning fee.

 

Ticketing fees are applicable when booking airfare only or as a separate component. Airfare included as part of an air-inclusive vacation package is not subject to the ticketing and change fees listed below. All fees are non-refundable and are in addition to fees that may be charged by the supplier.

 

Initial Phone Consultation: Free

Cruise or All-Inclusive Package Planning Fee, per room: $150

Fully Independent Travel (FIT) Planning Fee, per family: $350

Group Planning Fee, per room (10 or more people): $50

Domestic Air Ticketing Fee, per person: $75

International Air Ticketing Fee, per person: $150

Airfare Change Fee, per ticket: $50

Change fee: $50

Cancellation Fee: $100

Flight Information:
Read your travel documentation carefully for arrival and departure instructions, including terminal information,
check-in locations, and flight times. Flight times are tentative and subject to change.

 

Airline Responsibility:
Travel Agency shall not be held liable for loss or damage to property or injury of person caused by reason of any
defect, negligence, or other wrongful act or omission by any other transportation company, hotel agency or party providing such services or facilities, strike, war, weather, quarantine, sickness, government restrictions or
regulations, or any other cause beyond its reasonable control. Travel Agency is not liable for any claim arising out

of or in connection with carriage or other services or features otherwise performed or occurring in connection with this package.

 

Once airline flight has been booked and ticketed with an airline, tickets are non-refundable and non-transferable.
Customers are subject to all airline carriers rules. For specific details, visit the carriers website. Flight details,
including arrival and departure times are subject to change. It is the Customer’s responsibility to check-in for their
flight 24-hours in advanced of their departure. It is the Customer’s responsibility to monitor their flight time. Travel Agency recommends Customer arrives two hours early for domestic flights, and three hours early for international.


Customer is responsible to have knowledge of all travel requirements and laws. It is required for Customer to
comply with all local and federal laws. Customers can http:// www.faa.gov for information regarding federal
standards.

 

Credit Card Charges:
Customer understands that he/she shall be liable for any and all charges placed on credit cards in the event such
charges are declined or charged back for any reason, including any unauthorized or fraudulent use of credit cards.


Travel Agency shall not be held liable for any losses or damages associated with the fraudulent use of credit card
and client shall hold Travel Agency harmless from any and all losses, damages or claims of any kind.
Your signed credit card authorization is a binding agreement for charging your trip and/or components of your trip, and as such, you waive any right to a chargeback in the case of trip delays, changes, or cancellations for any cause (except fraud), and you agree to the refund policies and procedures as outlined in the terms and conditions by the supplier. In the event that you attempt (without our authorization) to chargeback or reverse a trip payment already made, we reserve the right to collect all additional costs, fees and expenses associated with such chargeback including, without limitation, attorney fees.

 

Final Payment:
Final payment must be received by the communicated due date. Travel Agency will remind Customer, but
Customer is responsible to ensure their final balance is paid. Travel Agency is not responsible for cancellations or
late fees.


Disclaimer of Warranties:
Travel Agency makes no representations or warranties, express or implied, including, to the extent permitted by
applicable law, any implied warranty of merchantability or fitness for a particular purpose. Travel Agency does not
warrant that your trip will meet Customer standards. Travel Agency will only be held liable to Customer if proven
to have acted grossly negligent.

 

Waivers and Limitations of Liability:
Customer and Travel Agency agree to limit claims against each other solely to direct damages. In other words,
neither of us will claim any damages that are indirect, special, consequential, incidental, treble, or punitive.
Customer agrees Travel Agency is not responsible by problems caused by Customer or others, or by any act of God.

Customer and Travel Agency have duty to mitigate all damages that may arise.
